IN THE NAME OF ALLAH, THE BENEFICENT, THE MERCIFUL
BEING THE FIRST SERMON FOR THE MONTH OF DHUL-QA’DAH 2/D. QA’DAH/1437AH (5/AUGUST/2016CE)

THE HAJJ: RULES AND ETIQUETTES.
All Praises belong to Allah Who commanded veneration of the sanctity of hajj, as a pointer to the piety of the hearts. He made hajj the distinguishing symbol of Islam from all other ideologies. Allah says: (ذَلِكَ وَمَنْ يُعَظِّمْ شَعَائِرَ اللَّهِ فَإِنَّهَا مِنْ تَقْوَى الْقُلُوبِ) “That [is so]. And whoever honors the symbols of Allah – indeed, it is from the piety of hearts. “ (22: 32). We celebrate His praises and seek help and guidance from Him. We believe in Him and put our trust in Him. Whom Allah guides surely is guided and whom He misleads, surely you will find no one to guide or protect him. I bear witness that there is no god except Allah alone, and that Muhammad (pbuh) is His servant and Messenger, who said: “Whoever performed Hajj and did not commit immoral act and disobedience, returns (home purified of sins as) as the day his mother bore him,” (Bukhari, and Muslim). Peace and blessings of Allah be on him, his family, companions and followers until the Day of recompense.

As to what follows,
Servants of Allah, I advise you and myself to fear Allah for that is the goal expected from hajj rites and other forms of worship. Allah says:
“الْحَجُّ أَشْهُرٌ مَّعْلُومَاتٌ فَمَن فَرَضَ فِيهِنَّ الْحَجَّ فَلاَ رَفَثَ وَلاَ فُسُوقَ وَلاَ جِدَالَ فِي الْحَجِّ وَمَا تَفْعَلُواْ مِنْ خَيْرٍ يَعْلَمْهُ اللّهُ وَتَزَوَّدُواْ فَإِنَّ خَيْرَ الزَّادِ التَّقْوَى وَاتَّقُونِ يَا أُوْلِي الأَلْبَابِ ”
“Hajj is [during] well-known months, so whoever has made Hajj obligatory upon himself therein [by entering the state of ihram], there is [to be for him] no sexual relations and no disobedience and no disputing during Hajj. And whatever good you do – Allah knows it. And take provisions, but indeed, the best provision is fear of Allah. And fear Me, O you of understanding.)” {2: 197}

Brothers and Sisters in Islam, having talked about preparation for Hajj and other related topics, we shall today discuss: HAJJ: RULES AND ETIQUETTES.

We commence by discussing the conditions for Hajj thus:

Conditions that make Hajj obligatory: theses could be either general conditions for both males and females or specific conditions regarding women alone.
General conditions could be subdivided into: conditions of obligation, soundness, and performance; this is Islam and to be mentally sound; others include conditions of obligation, and performance and not condition of soundness, this is puberty and freedom, others include condition of obligation alone and that is Ability.
 
The conditions are as follow: 
1 – Islam: Hajj is not compulsory for unbelievers so long they remain in disbelieve in this life. If they perform it, it is null and void, because they do not have the competence to perform ibadah. If such unbeliever performs the hajj and accepts Islam thereafter, hajj become mandatory on him newly, the earlier one stands irrelevant.
2- Puberty and Mental sanity: Hajj is not compulsory for the child or the insane person, for both are not requested under Islamic laws of any religious action. Hajj is not right from the insane perform. If the child and the insane perform hajj, they both have to perform a new hajj of Islam when the child reaches the age of puberty and the insane person recovers from his insanity.  The Prophet peace be upon him, said: “The pen is lifted from three, the sleeper until he wakes up, the child until he attains youth age, and the insane person until he gains saneness. (Abu Dawud, Ibn Majah and Tirmidhi). “Any child taken to hajj by his family, and dies, that suffices for him, but if he attains (age of puberty) the hajj is mandatory for him. And for any slave taken to hajj by his people and dies that suffices for him, but if he is set free he must perform the mandatory hajj of Islam.” (Ahmad & Hakim)
3- Freedom: Base on this prerequisite, hajjis not mandatory for the slave, because he has no capability. Hajj requires staying for a long time and traveling a distance and conveyance, in which case the slave will neglect right of his master.  
4- Capability. This includes physical ability, financial ability and availability of security. Summarises as the ability to reach Makkah. Alah says: (وَلِلَّهِ عَلَى النَّاسِ حِجُّ الْبَيْتِ مَنِ اسْتَطَاعَ إِلَيْهِ سَبِيلاً ” { آل عمران :3\97})
” And [due] to Allah from the people is a pilgrimage to the House – for whoever is able to find thereto a way. ” {Al-Imran: 3 \ 97}.

Specific  Conditions
This relates to women, and they are two conditions thus:

1- She should be in the company of her husband or any of her Mahram- i.e (relative which they could not be married to ever). Where this is not available, then hajj is not compulsory on her. Ibn Umar (Allah be pleased with them) reported Allah’s Messenger (may peace be upon him) as saying: A woman should not set out on three (days’ journey) except when she has a Mahram with her. Also, “A woman should not perform the hajj except the husband is with her.” (Ad-Daruqutni). Imam Shafi’i permits that it is permissible for a woman to perform the hajj if she is in the company of a group of trustworthy women, not just one person. Imam Malik permits that she could perform the hajj in company of trusted group of males only or women only or a combination of males and females. Both school of thoughts posit their evidence on the verse: “And [due] to Allah from the people is a pilgrimage to the House – for whoever is able to find thereto a way. ”

2- She should not be in the state of ‘Iddah- waiting period for divorce or death of her husband. Allah forbids her in this state to go out. Allah says: (﴿لا تخرجوهن من بيوتهن ولا يخرجن ﴾ [الطلاق:65\1]) “Do not turn them out of their [husbands’] houses, nor should they [themselves] leave [during that period] “ (65: 1). Because the Hajj can be performed at another time, while the ‘Iddah- waiting period is mandatory at the specified time; immediately after divorce or death. The Hanbali prevent the woman from going for Hajj during the waiting period for the demise of her husband but permits her in the case of Iddah for a decided divorce. This is because, to stay at home is a mandatory condition in the case of Iddah of the death but not for that of divorce.

Rites of Hajj and Umrah: 1 – Ihram: This is the intention of Hajj or Umrah or for both by saying: “I intend the Hajj or Umrah” Where someone performs the hajj or Umrah on behalf of another person, he would say: “I intend to perform the Hajj or Umrah for so and so person. Then he would utter the Talbiyyah immediately after the observance of two rakats prayer of Ihram.

2 –To enter Makkah through its heights i.e from the mountain path of Kadaa, then to enter the Ka’bah from the Banu  Shaybah Gate, then the pilgrim should perform the Tawaaf al-Qudoom (Tawaaf of Arrival) starting from the corner of the Black Stone.

3 – At-Tawaaf- Circumambulation is of three types: Tawaaf al- Qudoom (Tawaaf of Arrival), Tawaaf al-Ifadhoh (Tawaaf of visiting), and Tawaaf al-Wadaa (Tawaaf of farewell). Allah says: (وعهدنا إلي إبراهيم وإسماعيل أن طهرا بيتي للطائفين والعاكفين والركع السجود﴾ [البقرة:2\125]) “And We charged Abraham and Ishmael, [saying], “Purify My House for those who perform Tawaf and those who are staying [there] for worship and those who bow and prostrate [in prayer].” (2: 125)

4 – As-Sa’y- walking between Safa and Marwa. Allah says: (﴿إن الصفا والمروة من شعائر الله فمن حجَّ البيت أو اعتمر فلا جناح عليه أن يطّوف بهما﴾ [البقرة:2\158]) “Indeed, as-Safa and al-Marwah are among the symbols of Allah. So whoever makes Hajj to the House or performs ‘umrah – there is no blame upon him for walking between them ..” (2:158) 

5- Staying at Arafah and Mina: The pilgrim goes out to Mina on the eighth day of Dhul-hijjah, he should observe Zuhr and Asr prayer there, spend the night there, then set out towards Arafah after sunrise. On the ninth day, he would combine Zuhr and Asr prayers behind the Imam at the Namirah mosque or any other, then he stays at Arafah till sunset. One should engage himself in the remembrance of Allaah, supplication from the heart, reciting the Talbiyyah. You should not get involved with the people in idle talk or disputes, but rather, remain alone in order to call to Allah, praise Him, magnify Him and glorify Him.

6 – Staying overnight at Muzdalifah: It is a place between Mina and Arafat. At Muzdalifah, pilgrims combine Maghrib and Isha prayers shortening the Ishai prayer. They will also observe the Subh prayer within this Sacred precinct, stand to supplicate and pray, and then pay move to Mina before sunrise. This night is the night of the ‘Eidul Adha.
7 – Throwing of pebbles: The pilgrims will throw seven pebbles of stones on the Day of Sacrifice (10th day of D.Hijjah) at Mina at the Jamratul-‘Aqabah (a major pillar) after sunrise. After that, pilgrims are to throw the pebbles at all the three pillars on the days of Mina- these are the 11th, 12th, and 13th of D. hijjah between zawal (decline of the sun from its zenith) and sunset, starting with the minor or smallest pillar then the middle pillar, and then the ‘Aqabah.

8 – Shaving or cutting low the hair: Shaving is best for men, women would not shave but cut their hair low to a length of the fingertip. He should supplicate during the cutting, this happen on the 10th day of Dhul-hijjah, the Day of Sacrifice after throwing the pebbles at the Jamratul ‘Aqaba and slaughter of the sacrifice for he who has the sacrifice. The he goes to Makkah, do the Tawaaf- al- ifadhoh which an obligation of hajj.
9 – Slaughtering: Slaughtering takes place after throwing the pebbles of Jamratul ‘Aqabah. Shaving could be done before slaughtering and the slaughtering could come before throwing the pebbles. The slaughtering of the hadyu should be before sunrise.

10- Tawaaf al-Wadaa (Tawaaf of farewell): It considered desirable by the Maalikis but compulsory by others. It is not obligatory for people of Makkah or those who stay there who are non-Makkans. When a woman menstruates after the Tawaaf al-ifaadhoh, she leaves before the Tawaaf of farewell.
Rites of Umrah: These are four, namely: Ihram, Tawaaf, Sa’yy between Safa and Marwa, and Shaving or cutting of the hair.

Thirdly The Umrah of the Prophet, peace be upon him: Narrated Anas: «that the Prophet, peace be upon him performed four Umrah in Dhul- Qa’dah except that done with his hajj; Umrah at the Hudaybiyah, and the following year, that of Al-Ji’raanah where he share the spoils of Hunain, and the Umrah done with his hajj. » These are four Umrah thus: the Umrah of Hudaybiyah to visit the Sacred House in the sixth year of hijrah, and the Umrah of the seventh year, that of Al-Ji’raanah in the eighth year on the Hunain valley between Makkah and Taif, and the Umrah done with his Farewell hajj in the ninth year.

The Second Sermon
Praise be to Allah the Lord of the worlds. May the peace and blessings of Allah be upon Muhammad, his household, companions and all those who follow his footsteps till the day of judgement.
Allah says:
:﴿ وَالْوَالِدَاتُ يُرْضِعْنَ أَوْلَادَهُنَّ حَوْلَيْنِ كَامِلَيْنِ ۖ لِمَنْ أَرَادَ أَن يُتِمَّ الرَّضَاعَةَ ۚ وَعَلَى الْمَوْلُودِ لَهُ رِزْقُهُنَّ وَكِسْوَتُهُنَّ بِالْمَعْرُوفِ ۚ لَا تُكَلَّفُ نَفْسٌ إِلَّا وُسْعَهَا ۚ لَا تُضَارَّ وَالِدَةٌ بِوَلَدِهَا وَلَا مَوْلُودٌ لَّهُ بِوَلَدِهِ ۚ وَعَلَى الْوَارِثِ مِثْلُ ذَٰلِكَ ۗ فَإِنْ أَرَادَا فِصَالًا عَن تَرَاضٍ مِّنْهُمَا وَتَشَاوُرٍ فَلَا جُنَاحَ عَلَيْهِمَا ۗ وَإِنْ أَرَدتُّمْ أَن تَسْتَرْضِعُوا أَوْلَادَكُمْ فَلَا جُنَاحَ عَلَيْكُمْ إِذَا سَلَّمْتُم مَّا آتَيْتُم بِالْمَعْرُوفِ ۗ وَاتَّقُوا اللَّهَ وَاعْلَمُوا أَنَّ اللَّهَ بِمَا تَعْمَلُونَ بَصِيرٌ ﴾
Mothers may breastfeed their children two complete years for whoever wishes to complete the nursing [period]. Upon the father is the mothers’ provision and their clothing according to what is acceptable. No person is charged with more than his capacity. No mother should be harmed through her child, and no father through his child. And upon the [father’s] heir is [a duty] like that [of the father]. And if they both desire weaning through mutual consent from both of them and consultation, there is no blame upon either of them. And if you wish to have your children nursed by a substitute, there is no blame upon you as long as you give payment according to what is acceptable. And fear Allah and know that Allah is Seeing of what you do.. (2: 233)

Dear brothers and Sisters, the UNO commemorates the WORLD BREASTFEEDING WEEK between 1st and 7th in over 170 countries globally in the quest to encourage breast feeding for infants.
In the verse above however, the Qur’an has established that for more than 1400 years ago.

In addition to that, all praises are due to Allah, we commend the stately courage of the Nigerian army and all the security agents of government in their fight against the Niger Delta Avengers, who have been committing atrocities in Lagos and Ogun state. We charge them to sustain this fight against every vandal of our oil pipelines and all other threats to security in the country.
