TOWARDS A FREE, FAIR AND CREDIBLE ELECTIONS (English)

In The Name Of Allah, The Beneficent, The Merciful
BEING THE FOURTH SERMON FOR THE MONTH OF R/THAANI, 27TH R. THAANI/1440AH (4/JAN/2019CE)
TOWARDS A FREE, FAIR AND CREDIBLE ELECTIONS.
Praise be to Allah, Who says:

 (﴿فَلَنَسْأَلَنَّ الَّذِينَ أُرْسِلَ إِلَيْهِمْ وَلَنَسْأَلَنَّ الْمُرْسَلِينَ(6)فَلَنَقُصَنَّ عَلَيْهِمْ بِعِلْمٍ وَمَا كُنَّا غَائِبِينَ﴾[الأعراف :7\6-7])

and establish the evidence (as) before Allah. Such is the admonition given to him who believes in Allah and the Last Day.” (65:2)
We praise and thank Him, we believe in Him and place our trust in Him. We seek refuge in Him from the evils of our souls and deeds. He who Allah guides is guided, and he whom He mislead, you will not find for him any guiding protector. I testify there is no god but Allah alone, He has no partner, and I testify that Muhammad (pbuh) is his servant and messenger who said: He who employs a man among a group and within them is someone who is more pleasing to Allah than the person, surely he has betray Allah and His messenger and the believers.” (Al-Haakim)  O Allah, shower your peace and blessings upon him, his household, companions and whoever follows them in good deeds till the day of recompense.

As to what follows:

Dear worshippers of Allah, I advise you all and myself to fear Allah, the Exalted, for that is the way of the righteous and people of intellect. Allah, the Exalted says: (وَاتَّقُونِ يَا أُولِي الْأَلْبَابِ) So fear Me, o ye that are wise.” (2: 197)

Dear brothers in faith, today being the fourth Khutbah for Rabee’uth thaani we are continuing our series on politics and elections, therefore today’s topic is TOWARDS A FREE, FAIR AND CREDIBLE ELECTIONS, being the goal of every elections.

Dear brothers and sisters in Islam, our religion have left out no issue in life without a mention of it in the Qur’an or sunnah. Such thought by anyone is an evil thought against Allah. Allah says:

(﴿وَنَزَّلْنَا عَلَيْكَ الْكِتَابَ تِبْيَانًا لِكُلِّ شَيْءٍ وَهُدًى وَرَحْمَةً وَبُشْرَى لِلْمُسْلِمِينَ﴾ {سورة النحل:16\ 89 })

And We have sent down to you the Book as clarification for all things and as guidance and mercy and good tidings for the Muslims.” (16: 89)

Ibn kathir says: (Ibn Mas’ud said: “We have explained in this Qur’an every knowledge and all things.” Mujahid explains it as: “Every halal and haram”) The comment of Ibn Mas’ud seems wider and more encompassing, because the Qur’an contains every benefitting knowledge past, present and future, as well as the knowledge of the halal and haram, and what mankind need for life affair and the hereafter.) Ibn kathir 4/595.

The duty of the Muslim
It is the duty of a Muslim who lives in any society to contributes positively to resolve the issues of this community, according to the Islamic point of view. Therefore, if the opportunity to partake comes to him to elect persons to represent the people in legislative matters, or to choose the government, or in the offer of trust to such government or strip it of their trust, or to partake in such process in order to ward off evil for the society including other embedded benefits in joining the house of representatives. When the opportunity to participate is presented to the Muslim in electing these representatives, the Islamic law views that as an opportunity which a Muslim must not waste away. Because it is imperative for him to play a role in the removal of some of the evils, or in the spread of some good, or to ward off evil from people generally, which includes the Muslims, as well as in the effort to ward off evil from the nation, such evil in all its types that endanger all people and naturally include the Muslims.

He who withdraws from this responsibility commits sin:
But he who withdraws from participating in the electoral process has failed to perform this duty, even though he performs other religious duties, but those cannot stand as substitute for the elections. In addition to that, other religious activities can in no way take away the sins of not participating in this process which is both religious and civic obligation. He who participates has the reward and those who do not have their sins. Allah says:

(﴿وَأَقِيمُوا الشَّهَادَةَ لِلَّهِ ذَلِكُمْ يُوعَظُ بِهِ مَنْ كَانَ يُؤْمِنُ بِاللَّهِ وَالْيَوْمِ الْآخِرِ﴾{الطّلاق:65\2}  )

(and establish the testimony for [the acceptance of] Allah. That is instructed to whoever should believe in Allah and the Last day.)(65: 2)

(﴿وَلَا تَكْتُمُوا الشَّهَادَةَ وَمَنْ يَكْتُمْهَا فَإِنَّهُ آثِمٌ قَلْبُهُ وَاللَّهُ بِمَا تَعْمَلُونَ عَلِيمٌ﴾ {البقرة:2\283})

(And do not conceal testimony, for whoever conceals it – his heart is indeed sinful, and Allah is Knowing of what you do.) (2: 283)

Some evidence on the necessity to participate in the general elections:
Some jurisprudential principles for participation in election:
– Whatever matter that the obligation will not be achievable except through it is equally an obligation.
– A major harm is displaced with a lesser harm.
– Circumstantial caution is for achieving benefits and warding off evil
– Matters are judged on its purposes

Evidences from the Qur’an: Allah says:

(﴿وَلَا تَكْتُمُوا الشَّهَادَةَ وَمَنْ يَكْتُمْهَا فَإِنَّهُ آثِمٌ قَلْبُهُ وَاللَّهُ بِمَا تَعْمَلُونَ عَلِيمٌ﴾ {البقرة:2\283})

(And do not conceal testimony, for whoever conceals it – his heart is indeed sinful, and Allah is Knowing of what you do.) (2: 283)

(}  ﴿وَمَنْ أَظْلَمُ مِمَّنْ كَتَمَ شَهَادَةً عِنْدَهُ مِنَ اللَّهِ وَمَا اللَّهُ بِغَافِلٍ عَمَّا تَعْمَلُونَ   {سورة  البقرة:2\  140)

(And who is more unjust than one who conceals a testimony he has from Allah? And Allah is not unaware of what you do.) (2: 140)

(-﴿وَلَا يَأْبَ الشُّهَدَاءُ إِذَا مَا دُعُوا﴾  {سورة  البقرة:2\  282)

(And let not the witnesses refuse when they are called upon.)(2: 282)

(﴿وَلَا نَكْتُمُ شَهَادَةَ اللَّهِ إِنَّا إِذًا لَمِنَ الْآثِمِينَ ﴾  {سورة:5\  المائدة  106})

(and we will not withhold the testimony of Allah. Indeed, we would then be of the sinful.”) (5:106)

When two non-Muslims vie for the post of leadership in a non- Muslim or Muslim country:

When two non-Muslims vie for the post of presidency in a non- Muslim; if one of them has stronger hostility towards Islam and Muslims and the other is of lesser hostility, we would elect the one with lesser evil to repel the greater evil.

In this regard, Allah reported the rejoice of the companions of the Prophet on the victory of the Christians over the pagan Persians because the Christians are closer to us. How then is the effort to create relief for the Muslims in a land where Islam not practiced by appointing the better kafir, and void the opportunity for evil of the doomed.

Importance understanding of election:
Fundamentally in Islam, election should be partook in and not to be boycotted. As state in earlier sermons, election in Islam is regarded as:
1- Witness (Ash-shahaadah), Allah says:  (﴿وَأَقِيمُوا الشَّهَادَةَ لِلَّهِ ذَلِكُمْ يُوعَظُ بِهِ مَنْ كَانَ يُؤْمِنُ بِاللَّهِ وَالْيَوْمِ الْآخِرِ﴾{الطّلاق:65\2}  )( and establish the testimony for [the acceptance of] Allah. That is instructed to whoever should believe in Allah and the Last day.)(65: 2)

2- It is a recommendation (At-tazkiyah): The prophet said: “Whoever manages anything in the affairs of the Muslims, and he appoints a person out of favouritsm, the curse of Allah will be on him, Allah will not accept from him any act until He puts him in Jahannam.” (Haakim)

3- It is a form of delegating authority (Al-wakaalah): Allah says: (إِنَّ خَيْرَ مَنِ اسْتَأْجَرْتَ الْقَوِيُّ الْأَمِينُ﴾{القصص:28\ 26) ((Indeed, the best one you can hire is the strong and the trustworthy. 28: 26))

4- It is a trust (Al-amaanah): (﴿يَا أَيُّهَا الَّذِينَ آمَنُوا لَا تَخُونُوا اللَّهَ وَالرَّسُولَ وَتَخُونُوا أَمَانَاتِكُمْ وَأَنْتُمْ تَعْلَمُونَ﴾ {الأنفال:8 \27}) (O you who have believed, do not betray Allah and the Messenger or betray your trusts while you know [the consequence].) ( {Anfal :27}

The Messenger of Allah said: “When trust is lost, then wait for the Hour.” It was asked, “How will trust be lost, O Allah’s Apostle?” He said, “When authority is given to those who do not deserve it, then wait for the Hour.” (Bukhari)

Guiding rules for free, peaceful and credible elections:

  • That the benefits surpassed the disadvatages
  • That it is the better method to achieve the shariah-based benefits
  • There should not be false praises and excessive recommendations
  • There should not be extravagance and bribery
  • There should not be wasteful spending
  • There should not be destruction and spreading evil.

SECOND KHUTBAH

All praises are due to Allah, the lord of the worlds Who says: “… to you be your religion and to me is mine.” May the peace and blessings of Allah be upon the leader of the prophets, his household, companions and those who follow them in righteousness till the day of recompense.

Thereafter,

O worshippers of Allah at the moment it is deserving for us to show concern in the affairs of Muslims around the world. The prophet peace be upon him said: He who is not concerned about the affairs of the Muslims is not of them.

Firstly, our Muslim brothers in China suffer some agony and persecution from their secular government, and the detail is as follows: China to escalate repression of Muslims and lock up mosques of “Hui”
– International human rights reports speak of repressive measures being pursued by the Chinese authorities against Muslims – Getty
– BEIJING (Reuters) – Authorities in the southwestern state of Yuanan have closed three mosques in the Vishan region under the pretext of “teaching religious studies illegally,” Chinese media reported on Tuesday (January 1, 2019).
According to South China Morning Post, local authorities have banned worship in mosques on the pretext of teaching illegal religious studies, citing what they called “squabbles between the local security forces and Hui Muslims who tried to counter the closure of their mosques …

Second, the strike:
In the last two months, the strike of the university lecturers in Nigeria (ASUU) is still on. This ugly situation could make the students susceptible to being recruited for use as thugs during the coming elections and may lead to immeasurable failure in their learning experience. We implore every stakeholder including the government and the lecturers to seek a definitive solution to this problem, because the future of every nation rests on the educational plan of its youth.

Thirdly: Nigeria Labour Congress (NLC) Strike Action:
The Nigeria Nigeria Labor Congress is threatening to embark on a strike action due to the issue of the minimum wage they have been deliberating upon since. We advise the government, both federal and state governments to stand up to this responsibility and prevent any ugly or untold hardship on the populace.

Oh Allah descend peace; flowing with continuous tranquility and security upon Nigeria and all other Muslim nations. O Allah accept the worship of the pilgrims of hajj and Umrah, and grant us all Your pleasure, And the last of our call will be, “Praise to Allah, Lord of the worlds!”
